These Terms & Conditions govern your use of our website, services, and any engagement between you (“Client”, “you”) and Amazon Direct Publishers (“we”, “us”, “our”). Service Scope & Agreement
- We offer creative publishing services including but not limited to ghostwriting, editing, cover design, marketing, formatting, printing, distribution, and related support.
- Each project is governed by a mutual agreement or contract (email, signed document, or online order) which defines the specific deliverables, timeline, fees, and rights.
- We commit to performing our services professionally, to the best of our ability, and tailored to your instructions, but we cannot guarantee specific rankings, sales volumes, or outcomes.
Client Responsibilities
- You must provide accurate, lawful, and complete information and respond in timely fashion to our requests (feedback, materials, approvals).
- You guarantee that any content you supply (manuscript, images, data) does not infringe copyrights, trademarks, or third-party rights, and you grant us permission to use those materials for the project.
- You are responsible for reviewing drafts, changes, and final files. Feedback should be provided within agreed timeframes; delays may impact delivery.
Fees, Payment & Refunds
- Project fees are as agreed in your contract/order. A deposit may be required before work begins.
- Payments are accepted via approved payment methods. We do not store your credit card or banking information.
- If you cancel the project after work has begun, you may forfeit part or all of the deposit depending on how much work has been done.
- We perform work in good faith, but we cannot offer full refunds for completed work, revisions, or services already rendered.
Intellectual Property & Rights
- Upon full payment, you retain exclusive ownership of the final deliverables (manuscript, design files, marketing materials, etc.), unless otherwise specified in the contract.
- We may retain anonymized, non-identifying portfolios or samples of work with your permission only, for showcasing on our website or marketing materials.
Revisions & Quality Assurance
- Our service agreements include a specified number of revisions. Additional revisions may incur extra cost.
- We aim to deliver high-quality, original work. We do not guarantee absolute perfection, but we commit to reasonable standards of clarity, coherence, and correctness.
Confidentiality & Non-Disclosure
- All materials provided by you are treated as confidential and will not be shared with third parties without your consent, except as needed to fulfill the project (e.g. to a printer) or as required by law.
- We also require that you keep certain project details confidential as mutually agreed (if applicable), especially for unreleased content.
Liability & Disclaimers
- While we strive for excellence in every project, outcomes such as sales or rankings depend on external factors beyond our control.
- To the fullest extent permitted by law, Amazon Direct Publishers is not liable for indirect, incidental, or consequential damages arising from use of our services.
- Our total liability in any case will not exceed the fees you paid for the specific service.
Termination
- Either party may terminate the agreement if the other materially breaches terms, with written notice.
- Upon termination, you pay for work already completed. We deliver whatever complete parts are ready, subject to payment and rights as per contract.
Changes to Terms
We may update these Terms & Conditions from time to time. We will post the revised version on our website, with a “Last Updated” date. Continued use of our services after changes implies acceptance of the updated terms.
Dispute Resolution
If a dispute arises, we commit to good faith negotiation first. If unresolved, the dispute may be resolved by mediation or legal process in the jurisdiction agreed upon in your contract.
Governing Law
These terms are governed by the laws of the jurisdiction where Amazon Direct Publishers is legally registered (to be specified).
